These terms govern the use of the website www.looplywatersports.com, the demo and the Looply software, offered by Looply Technologies LLC. By activating a demo, a free trial or a subscription you accept them. They are written in plain language on purpose: if anything is unclear, write to us before activating.
1. What this is about
Looply is subscription management software (software as a service) for water sports schools and centres: lesson schedule and planning, instructors, boats, rentals, online bookings, memberships, accounts and payments, staff, financial analysis and more. Each school uses it at its own address schoolname.looplywatersports.com, in five languages, from computer and phone.
The service is provided by Looply Technologies LLC, 1209 Mountain Road Pl NE, Ste N, Albuquerque, NM 87110, United States ("Looply", "we"). The customer is the school or centre that activates the service ("the school", "you"). Looply is intended for professional use, not for consumers.
2. Account and demo
Demo. On demo.looplywatersports.com you leave your name, WhatsApp and email and receive a personal 48-hour login to a sample school already full of dummy data. The demo is for trying things out: the data you enter there is deleted at the end and does not carry over to the subscription.
Account. When you activate Looply, the school receives an owner account (Owner) that can create the other users (managers, office, instructors) with the permissions it chooses. Each person uses their own credentials: they must not be shared. The school is responsible for what its users do and must tell us at once if it suspects unauthorised access.
The information you give us to activate the account must be true and up to date.
3. Free trial
Every new school gets a 15-day free trial with every feature, no card needed. At the end of the trial, if you do not activate a plan, access is blocked; the data you entered stays available for 60 days, then it is deleted. If you activate a plan, the trial data stays and you carry on where you left off.
4. Prices and payment
The plans at the date of this text are:
- Essential: €59 per month or €590 per year;
- Pro: €109 per month or €1,090 per year;
- Elite: €159 per month or €1,590 per year;
- Enterprise: custom, on quotation;
- Office only: €29 per month, for a closed school that keeps selling next season (2 managers, operations read-only).
Additional services: off-season pause at €9 per month (the software stays available read-only while the school is closed), accommodation management added to the plan (€9 per month up to 10 rooms, €19 up to 20, €29 up to 35; or €90, €190, €290 per year), data import from other systems at a one-off €50, custom development on quotation.
All prices are exclusive of VAT and other taxes, which are added where due. The prices in force are always those published on the Pricing page of the site; if we change them, for active subscriptions the new price applies from the next renewal and we notify you by email at least 30 days in advance.
Payment is by card through Stripe, at the start of each period (month or year), automatically until cancellation. If a payment fails, we notify you and retry; if it is not settled, access may be suspended until the payment arrives.
5. Duration and cancellation
The monthly subscription renews every month: you can cancel at any time, from the settings or by writing to us, and it stays active until the end of the month already paid. We do not refund the current month.
The yearly subscription renews every year: you can cancel at any time and the cancellation takes effect at the end of the year already paid; there is no refund for unused months.
We may suspend or close an account if it breaches these terms (section 6) or if payments remain outstanding, giving you notice first where possible. We may also stop offering the service with at least 90 days' notice by email: in that case we refund the unused part of the subscription.
After the contract ends you can export your data (section 7).
6. Acceptable use
You may use Looply to run your business. You may not:
- resell it, rent it out or let schools other than yours use it without written agreement;
- copy its code, try to bypass its protections or deliberately overload the servers;
- upload illegal content, viruses or data you have no right to use;
- use the WhatsApp linked to the software to send unwanted or bulk messages to people who did not ask for them: besides breaching these terms, it risks WhatsApp blocking the number.
The school remains responsible for the content and data it enters and for complying with the laws that apply to it (tax, safety, privacy towards its clients).
7. Data and backups
The school's data stays the school's. Looply processes it only to provide the service, as data processor on the school's behalf (see the privacy policy). We do not use it for other purposes and we do not pass it on to third parties.
We make regular backups, which we keep for 30 days. You can export your data at any time from the software (PDF and CSV of the main lists) and, on request, ask us for a full export during the contract and for 30 days after it ends. After that period we delete the data, backups included.
We still recommend downloading regularly the documents you need by law (invoices, members' register, signed PDFs).
8. Availability and liability
We work to keep Looply reachable at all times, but we cannot guarantee it one hundred percent: there may be interruptions for maintenance (we give notice first where possible), provider failures or causes beyond our control. Looply is provided "as is" and we improve it continuously: some features may change or be replaced.
To the extent permitted by law, we are not liable for indirect damages (for example lost lessons, lost takings, reputational damage) and our total liability towards the school is limited to what the school paid us in the 12 months before the event.
Looply is a working tool: decisions about lessons, safety on the water, students' fitness, staff contracts and tax compliance remain the school's. Linked third-party services (Stripe, WhatsApp, Beds24, weather services) are subject to their providers' terms.
9. Intellectual property
The Looply software, name, logo and site content belong to Looply Technologies LLC. The subscription gives you the right to use them for your business, not to take ownership of them. The school's logo and materials remain the school's: we show them in the app only because you ask us to.
10. Governing law and jurisdiction
These terms are governed by the laws of the State of New Mexico, United States. Any dispute falls under the jurisdiction of the courts of Albuquerque, New Mexico; before getting there we commit to seeking an agreement between us.
If you use Looply as a consumer resident in the European Union, nothing in these terms removes the protections that the law of your country guarantees you as mandatory rights, including the right to bring a claim before the courts of your country.
11. Changes and contact
We may update these terms when the service or the law changes. We notify clients of significant changes by email at least 30 days in advance; if you do not accept them you can cancel before they take effect. The date at the top shows which version is in force.
